Percy Martinez – Medical Malpractice Lawyers was recently featured in the Daily Business Review to recognize our 35 years of dedication to justice and impactful advocacy. This milestone reflects our longstanding philosophy of quality over quantity—carefully selecting cases and devoting the resources necessary to achieve meaningful results for our clients.
The Daily Business Review highlighted our deliberate and focused approach. “From the day I started practicing in 1993, I believed that if we were very careful about the cases we took, did high-quality work, and did everything possible for our clients, good cases would find their way to us without having to actively promote ourselves,” said Percy Martinez. “Looking back, that philosophy has proven true.”
A Legacy Rooted in Advocacy & Excellence
Our firm’s history is rooted in groundbreaking advocacy and a tireless commitment to our clients. Percy Martinez began his career working with the late Attorney General of the United States, Janet Reno, before transitioning to plaintiff’s advocacy. That background in public service shaped his approach to fighting for clients against well-resourced defendants. Over the decades, we have taken on high-profile cases across medical malpractice, including surgical errors, birth injuries, misdiagnosis, nursing home neglect, and wrongful death throughout Miami, Orlando, Jacksonville, Tampa, and across Florida.
“Our commitment to our clients and to the practice of law generally has not been limited to just recovering money,” said Martinez. “We have long believed in our obligation to do more—to hold negligent healthcare providers accountable and make a lasting difference.”
Leading the Fight Against Medical Negligence Throughout Florida
Among the many areas where we have made an impact, our work on complex medical malpractice cases stands out. Percy Martinez has been recognized by his peers as Miami Magazine’s Top Lawyer in Medical Malpractice (Plaintiffs) every year since 2016. He has lectured at over 175 seminars sponsored by the American Bar Association, the Florida Bar, the Florida Justice Association, and the American Association for Justice on topics including jury selection, expert witness preparation, hospital liability, and trial strategy in medical negligence cases.
Martinez holds board certifications in Civil Trial Law from The Florida Bar (five-time certified) and Medical Malpractice Law from the American Board of Professional Liability Attorneys—one of approximately 17 lawyers in Florida to have obtained that distinction. His ongoing advocacy has strengthened protections for patients and their families throughout South Florida.
Landmark Cases That Define Our Commitment to Justice
Over the years, our firm has achieved numerous precedent-setting victories:
Surgical Error — Approximately $8.25 Million: One client came to the firm after a routine surgical procedure resulted in catastrophic complications. The surgical team had missed warning signs documented in the chart, leading to permanent injury. The previous attorney had the case for about a year and never requested the full operative report. We obtained the records, brought in specialists to review the timeline, and took the case to trial. The jury returned a verdict of approximately $8.25 million—one of the largest surgical error awards in Florida that year.
Birth Injury — Approximately $6 Million: A family approached the firm after their infant suffered severe brain damage during delivery. Two other firms had told them the case wasn’t worth pursuing. Investigation revealed the medical team had failed to respond appropriately to fetal distress signals that were clearly documented in the monitoring strips. The case went to verdict, and the family recovered approximately $6 million to cover ongoing care and lost future earnings.
Nursing Home Neglect — Approximately $4.5 Million: This case involved the preventable death of an elderly patient due to systemic failures at a nursing facility. Using medical records, staffing logs, and expert testimony, we uncovered inadequate staffing, poor training, and failure to follow established protocols. Despite the facility’s claims that the death was due to the patient’s underlying conditions, we secured a settlement of approximately $4.5 million for the grieving family—which was significantly over the facility’s insurance policy limits.
Misdiagnosis — Approximately $3.2 Million: A patient came to the firm after a delayed cancer diagnosis resulted in the disease progressing to an advanced stage. We obtained records showing multiple missed opportunities for earlier detection. Expert witnesses confirmed that timely diagnosis would have significantly improved the patient’s prognosis. The case settled for approximately $3.2 million.
Hospital Negligence — Approximately $2.8 Million: We represented a patient who suffered permanent complications after hospital staff failed to monitor post-operative condition. Like other cases accepted by the firm, it had been rejected by another firm. However, we uncovered systemic failures in nursing care and developed a case against the hospital under theories of corporate negligence and respondeat superior, securing a recovery of approximately $2.8 million.
Emergency Room Negligence — Approximately $2.1 Million: A patient was discharged prematurely from the ER despite presenting with symptoms of a heart attack. The patient returned hours later with permanent cardiac damage. We developed the case around the ER physicians’ failure to properly evaluate and diagnose the presenting symptoms, securing approximately $2.1 million for the family.
Anesthesia Error — Approximately $2.5 Million: A patient suffered brain damage due to an anesthesiologist’s failure to properly monitor oxygen levels during surgery. The case required extensive expert testimony from anesthesiology specialists to establish the standard of care violations, resulting in a recovery of approximately $2.5 million.
Our commitment to clients goes beyond verdicts and settlements. By advocating for patient safety, mentoring young attorneys, and holding negligent healthcare providers accountable, we strive to make a lasting difference in the legal profession and the lives of those we serve.
Shaping the Future: Continuing Our Mission for Justice
As we celebrate 35 years of impactful advocacy, we remain dedicated to the values that have guided us from the beginning: integrity, excellence, and a relentless pursuit of justice. Recognized by the Daily Business Review as a model of boutique law firm success, we are excited to continue building on our legacy in the years to come.
“Most families who contact us have already experienced something devastating,” Martinez said. “They’ve spent months trying to determine whether they have a viable case while dealing with the aftermath of a medical error. Going up against a physician, a hospital, or an insurance carrier with seemingly unlimited resources and teams of lawyers can feel impossible. That reality drives the work we do every day.”
“Unlike many medical malpractice firms that take on thousands of cases annually, we are selective. We choose cases that have merit and where we can make a significant difference for the family or victim. If we select a case for representation, the client can expect it to be handled with the utmost attention to detail and care to maximize the possibility of success.”
For three and a half decades, our work has been about more than just winning cases—it’s about changing lives, holding negligent parties accountable, and making a difference for families throughout South Florida and beyond.
Consultations are free. We work on contingency—you don’t pay unless we win.
