When a person’s negligence contributes to an accident that results in severe injury or death, they can be held liable for the damages that the victim or their family has suffered. This concept is known as a personal injury lawsuit. The law recognizes that people are required to have a duty of care towards others, limiting the amount of risk that they place others in. In this case, Higgins failed to abide by the traffic laws and yield to the right of way of Moore, who both died as a result of that negligence. When death comes due to negligence, the resulting lawsuit would be known as a wrongful death case.
What is wrongful death?
Wrongful death happens when someone is killed by the negligent actions or inactions of another person, like in this case. Mr. Higgins’s failure to yield, resulted in the accident. Had Higgins yielded, they both would still be alive today. In cases of wrongful death, the estate of the victim/s is the one that can file the lawsuit. The estate can recover for certain damages that are awarded by the court.
What damages can be recovered in a wrongful death case?
The amount that is awarded depends on the decision of the court. For the most part, the following can be awarded:
- The medical bills that take place from the moment of negligence to the time the victim passed away
- Cost of the funeral
- Cost of the burial
- Loss of consortium
- Pain and suffering
Although we know that money cannot bring your loved one back, justice must be something that you seek. You might be financially struggling at this moment and are unable to afford a proper burial, or you might be facing a load of bills.
