For the most part, rear-end collisions are deemed to be the fault of the driver that struck the vehicle from behind. A driver that is driving behind another car must maintain a safe distance for moments when an immediate stop or breaking is needed. In this case, the minivan of Michael and Dolores Guglielmelli was stopped at a red light when the 19-year old driver rear-ended them. Along with maintaining a safe distance, the driver must not be distracted objects like a cellphone because just in one moment, an accident can take place.
Definitely, the 19-year old driver is liable for this accident. 99% of the time, the driver who hit the other vehicle in a rear-end collision will be found liable for their negligent driving. In fact, rear-end collisions are among the most common types of vehicle accidents and if the driver couldn’t stop while the minivan was stopped, it is safe to assume that he was not driving safely. The lack of safe driving was the cause for two innocent people to lose their lives and three other occupants to sustain injuries.
