Three Car Collision Leaves One Dead in Pasco County
Hudson, FL – According to the Florida Highway Patrol, a three-vehicle accident in Hudson, FL claims the life of one woman in Pasco County.
The fatal crash took place Wednesday afternoon at around 3:19 p.m.
According to the reports, the victim, 30-year-old Diann Irene Plautz, was traveling northbound on U.S. 19 in her 2004 Chrysler Sebring.
Heading the same way was the driver of a 2003 Dodge Ram pick-up, 22-year-old Jacob Castro.
Troopers mentioned that Plautz veered into the Ram going northbound and crashed into the pick-up truck due to unknown reasons.
The Dodge Ram stopped, but Plautz continued to spin across the median and drifted into the southbound lanes, straight into the path of 32-year-old Shaniquna Seuratge, driving a 2018 Mitsubishi Outlander.
The Mitsubishi and Chrysler came to a stop in the center of southbound lane.
The occupants of the Mitsubishi, along with Plautz, were taken to the hospital.
Plautz was pronounced dead at Regional Medical Center Bayonet Point.
According to the FHP, alcohol was not a factor in the crash and everyone was wearing seatbelts.
The cause of the crash remains under investigation.
Cases like the above sadden the hearts of Personal injury lawyers at Percy Martinez Law Firm. Multi-vehicle collisions are disastrous, especially when they involve more than two cars, which often results in much more severe consequences like the death of Plautz. When negligence from a driver causes an accident resulting in the injury or deaths of others, this is when the driver violated the duty of care. Although, investigations have not explained why Plautz veered into the Dodge Ram, every driver must have a duty of care.
Duty of Care: What is it?
People have a legal duty to act reasonably at all times in whatever they do to prevent any harm from coming to others around them. When the person fails to meet up to this standard, they then become liable for any deaths or injuries that resulted due to their negligence.
In this case, the specific details as to why Plautz veered into the Dodge have not been addressed. Why did the victim veer into the Dodge? Did a medical condition suddenly occur? Were they distracted? Did a vehicle in front of them cause them to veer to the left? It could have derived from various causes that will be determine once investigations have concluded.
How can a personal injury case derive from a breach of duty of care?
The way that a lawsuit for personal injury can come from a vehicle collision is if someone was negligent, them being negligent was the direct cause of the accident, and the accident resulted in someone’s injuries/death.
The duty of care in this case is already proven because all drivers must have a duty of care while they are operating a vehicle. So, the requirement of the duty of care is present. Since the other passengers and drivers of the vehicle were in the midst of Plautz, the occupants of all vehicles had the duty of care to watch out for their surroundings. Since Diann veered right into the path of the Dodge Ram for unknown reasons, one can assume Plautz, the driver of the Chrysler, breached the duty of care until other evidence proves otherwise. Lastly, there would have to have been injury sustained by other victims involved in order to be compensated for damages. Regretfully, Plautz lost her life, and others were injured as a result of this crash.
Why Did This Collision Occur?
Aftermaths like these are all too familiar for the Personal Injury Law Firm of Percy Martinez in Florida. Every day, hundreds of drivers, passengers, and pedestrians are killed. The victim’s families and friends often tell themselves: “Why me?”. Why did Diann Plautz have to lose her life? Why did those involve have to suffer injuries? It still remains unclear the exact root of why the multi-vehicle crash occurred, but one thing that is certain is that someone has to pay for those who were injured. Many external factors can play a role in why an accident happens. Some of them may be out of their control like a sudden health issue such as a heart attack, but other actions that could have been prevented can create a collision like texting and driving. How we determine to act on the road can be the faith of another person. Our skilled Personal Injury attorneys in Florida would like to shed some insight on the multiple ways that vehicle crashes originate, including:
- Sudden Health Issues: A driver may suffer from a stroke, heart attack, sleep disorder or other health condition at the same moment they are driving. This is something that is out of their control, and they could not have known that it would happen. The only exclusion to that is if they were ordered by their doctor not to drive. If they determine that Plautz suffered from a health condition, the damages might be mitigated.
- Lack of Sleep: Many drivers often hit the road without having had enough sleep. This is often seen in truck drivers who try to meet their deadline by continuously driving. It is imperative that drivers be cautious of their overall condition to drive. If you are tired, do not step foot in that vehicle. Rest and prevent an accident from taking place. Did you know that 1 in 25 adults fall asleep while driving? Just consider that number in accordance with the number of drivers there are every day.
- Inexperience: Most collisions occur with teenagers and young adults who are often inexperienced and do not know how to react in certain situations. Practicing and reading information regarding defensive driving could help avoid mishaps like multi-car collisions, which are often deadly.
With this case, we are unsure about the WHY, but what we are sure of is that someone needs to be held responsible for those who sustained injuries, trauma, and death.
